Terms of Service

1. Agreement to Terms

By accessing or using StoreySafe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

StoreySafe is a building safety management platform designed to help organizations comply with the Building Safety Act 2022. The Service includes safety case management, building information management, compliance tracking, resident engagement features, and related tools.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Types

Different account types (Admin, Manager, Viewer) have different permissions. The account administrator is responsible for managing user access and permissions within their organization.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Upload false, misleading, or inaccurate building safety information
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to transmit viruses, malware, or other malicious code
• Copy, modify, or distribute the Service or its content without permission
• Use automated systems to access the Service without our consent

5. User Content

5.1 Ownership

You retain ownership of all content you upload to the Service ("User Content"). By uploading User Content, you grant us a license to use, store, and process that content to provide the Service.

5.2 Responsibility

You are solely responsible for your User Content and for ensuring it is accurate and complies with applicable laws and regulations. We do not verify or validate building safety information you upload.

6. Subscription and Payment

6.1 Pricing

The Service is offered in Free, Pro, and Enterprise tiers. Current pricing is available on our Pricing page. We reserve the right to change pricing with reasonable notice.

6.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all applicable fees.

6.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. Refunds are not provided for partial billing periods.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by StoreySafe and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

STOREYSAFE IS A TOOL TO ASSIST WITH BUILDING SAFETY MANAGEMENT. WE DO NOT PROVIDE LEGAL, ENGINEERING, OR PROFESSIONAL ADVICE. YOU ARE RESPONSIBLE FOR ENSURING COMPLIANCE WITH THE BUILDING SAFETY ACT 2022 AND ALL OTHER APPLICABLE REGULATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOREYSAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless StoreySafe and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
